Explanation

"How does distribution of the material advance the course objectives?" needs to be asked. If there is not a good explanation as to how the objectives are supported by the material, it is unlikely that fair use applies. For example, while scanning the morning paper a member of the faculty sees an editorial cartoon that she thinks is very funny so he decides to copy it for her students. If distributing the editorial cartoon was simply for educational purposes it is unlikely that fair use would apply. However, if the cartoon was on a subject that was being covered in class and discussing the cartoon would help students better understand course objectives, fair use might apply.
